Acceptance of Terms
By accessing and using Immersed ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
These Terms of Service ("Terms") govern your use of the Immersed desktop application and website, which are owned and operated by the Immersed team.
User Accounts
Account Creation
To use certain features of Immersed, you must create an account. You agree to:
- • Provide accurate and complete information
- • Maintain the security of your account credentials
- • Accept responsibility for all activities under your account
- • Notify us immediately of any unauthorized use
Account Termination
We reserve the right to terminate or suspend your account at our discretion, with or without notice, for any reason including violation of these Terms.
Subscription and Billing
Subscription Plans
Immersed offers three subscription tiers: Free, Pro Monthly, and Lifetime. Subscription fees are billed in advance and are non-refundable except as required by law.
Current Pricing:
- • Free: $0/month (limited features)
- • Pro Monthly: $4.99/month
- • Lifetime: $99 one-time payment
Payment Processing
Payments are processed securely through Stripe. By subscribing, you agree to Stripe's terms of service. We do not store your payment information on our servers.
Refunds
All subscription payments are final and non-refundable, except in cases where:
- • The service fails to deliver as described
- • Technical issues prevent access for more than 7 consecutive days
- • Required by applicable consumer protection laws
User Conduct and Responsibilities
You agree to use Immersed only for lawful purposes and in accordance with these Terms. You are responsible for:
- • All content you create or upload
- • Maintaining the confidentiality of your account
- • All activities that occur under your account
- • Complying with all applicable laws and regulations
Prohibited Activities
You may not use Immersed to create, distribute, or promote illegal content, harass others, or violate any laws or regulations.
Intellectual Property
Immersed IP
The Immersed service, including its software, design, logos, and content, is owned by the Immersed team and is protected by copyright, trademark, and other intellectual property laws.
User Content
You retain ownership of the content you create using Immersed (tasks, notes, etc.). However, by using the service, you grant us a limited license to store, process, and display your content as necessary to provide the service.
License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use Immersed for personal productivity purposes.
Privacy and Data
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Immersed, you consent to the collection and use of your information as outlined in our Privacy Policy.
We use Firebase for data storage and implement industry-standard security measures to protect your data. However, you acknowledge that no method of transmission over the internet is 100% secure.
Disclaimer of Warranties
Immersed is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted or error-free.
Limitation of Liability
In no event shall the Immersed team be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.
Our total liability for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid for the service in the 12 months preceding the claim.
Service Availability
While we strive to provide continuous service, Immersed may be temporarily unavailable due to maintenance, updates, or technical issues. We will make reasonable efforts to minimize service disruptions and notify users of planned maintenance.
We reserve the right to modify, suspend, or discontinue the service at any time with or without notice. We will provide reasonable notice for significant changes that affect service availability.
Changes to Terms
We may modify these Terms at any time. When we make changes, we will update the "Last updated" date and notify users through the app or website. Your continued use of Immersed after such modifications constitutes acceptance of the updated Terms.
For significant changes, we will provide additional notice and may require explicit consent.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Immersed team is based, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration.
